Police presence near bars, restaurants, and nightlife districts is common. Law enforcement agencies often justify these patrols as public safety measures, especially in areas where alcohol consumption is frequent. However, there is a legal line between lawful patrol and unlawful baiting.

While this practice is not classic entrapment, it can still cross into illegal territory under certain circumstances. What Is Police Baiting?

Police baiting occurs when officers deliberately position themselves near known drinking establishments and wait for patrons to leave, with the intent of stopping them for minor or technical traffic violations.

This is different from responding to observed dangerous driving. Instead, officers are proactively targeting a specific location and group of drivers based on an assumption that they may be impaired. Officers will often sit just out of sight near a bar or restaurant and wait for vehicles to exit the area. Once a driver leaves, officers follow closely and look for any small infraction, such as touching a lane line or failing to signal for a full distance.

Is a Cop Waiting Outside a Bar Entrapment?

Legally speaking, baiting is not the same as entrapment.

Entrapment requires that law enforcement induce someone to commit a crime they otherwise would not have committed. Simply waiting for someone to drive after drinking does not meet that definition.

However, the absence of entrapment does not automatically make the stop lawful.

Police must still have valid probable cause or reasonable suspicion for the traffic stop itself. If officers are manufacturing stops by aggressively searching for trivial violations solely because of a driver’s location, the legality of the stop can be challenged.
