Aggravated Assault under Ohio Law
ORC §2903.12 states that no person, while under the influence of sudden passion or in a sudden fit of rage, either of which is brought on by serious provocation occasioned by the victim that is reasonably sufficient to incite the person into using deadly force, shall knowingly:
- Cause serious physical harm to another or to another’s unborn;
- Cause or attempt to cause physical harm to another or to another’s unborn by means of a deadly weapon or dangerous ordnance
An aggravated assault charge, in most cases, will be classified as a felony of the fourth degree. If convicted, this charge comes with a presumptive sentence of up to 18 months in jail and / or fines of up to $5,000.
If the aggravated assault was committed on a law enforcement officer or an investigator of the bureau or criminal identification and investigation, it is considered a felony of the third degree. This charge, if proven guilty, will come with a presumptive sentence of up to 5 years in prison and / or fines of up to $10,000.
